The Ethical Pitfalls of Dual Agency

Both ends of the deal !  Is there anything better?  It has the ability to take a $500,000 deal and turn it into a million dollar commission.  As enticing as this seems it comes with many pitfalls and danger zones for Real estate Agents.  We all know the rules from Real Estate Schools.  Until a property is out of Attorney Review and listed in the MLS all offers must be presented and considered.  We owe it to our clients to assure all offers are presented and negotiated in an effort to get them the best price possible for their home.  That is our fiduciary responsibility to our clients.  This includes even and especially if we have our own offer as a dual agent.  Making it difficult or nearly impossible for another offer to be presented is highly unprofessional and a direct violation of our fiduciary responsibility to the client.

                         If you encounter this situation here’s some pro-active steps to take.  If the listing your client is interested in and the listing agent tells you your offer will be considered as a back up while it’s still listed as active,  that’s a “red flag”.  At that point you’ll want to speak to the Broker of Record and express your concerns.  You’ll want to get the seller’s attorney’s information and inform them you have an offer you’d like presented on their clients property.  The Attorney has the same fiduciary responsibility to his client as the agent does.  The attorney will always do the right thing as his fee is not effected by the price.

When multiple offers are on the table the agent acting in their clients best interest will always call for a “best and final”  to assure their client is getting top dollar for their home. If your client is willing to come up in price you have the obligation to demand one. Only a handful of State allow Dual Agency mostly due to the temptation to act somewhat less than than ethically.  In New Jersey licensed Real Estate Agents are expected to police themselves in this area by adhering to our Code of Ethics.  It’s up to us as professionals to hold each other’s feet to the fire.

Grimy bathroom walls are a major red flag to buyers. Here is an easy way to get rid of surface mold: Mix a spray bottle with one part water and one part bleach. Just spray it on the wall, and watch the mold disappear. Give it a fresh coat of paint, and your grimy bathroom will go from red flag to red-hot.

A master bedroom should appeal to both sexes. When you are selling, your master bedroom should appeal to buyers of both sexes. Get rid of features that seem too gender-specific. Paint the walls a neutral color, and choose bedding that matches. Then accessorize with items that complement the overall color scheme.
